Findings
The Alleged Victim (AV) has an identified food allergy. On or about November 15, 2024, AV ingested a dessert provided by the facility which included the identified food allergy. AV suffered an allergic reaction and had to receive and injectable medication to treat the allergy. AV was monitored and improved but had continuing symptoms for several hours. Respondent failed to ensure food safety for AV, keeping him/her safe from an allergic reaction. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
