- Alleged Victim's (AV) service plan, dated September 26, 2024, indicates AV has behaviors of swatting at staff and yelling. Interventions staff to take AV for a walk outside or to AV's room if AV is showing signs of being upset; staff to help AV to AV's room if AV seems to be looking for it or trying to enter another resident's room. Witness 1 (W1) Service Plan, dated September 26, 2024, indicates W1 has behavior of stomping W1 feet and yelling, impacting factor W1 does not like when people try and push W1 wheelchair and people being in W1 space. Interventions If W1 is seen propelling around the halls, staff are to offer W1 an activity; If staff observe W1 getting close to other residents where W1 can grab at them, they are to redirect and offer W1 a hot beverage; If staff observe W1 becoming frustrated or agitated, they are to ask W1 to sing a song. On or about November 27, 2024, AV was self-propelling in AV’s wheelchair in the hallways of the facility while yelling for help. AV went passed by W1’s room, W1 became agitated, W1 followed AV, grabbed AV’s wheelchair, turned AV around to face W1, and struck AV in the face leaving redness to AV's left cheek. The facility failed to follow the service plan and interventions in place for AV if AV is yelling by not offering to take AV for walk outside. The facility failed to follow the service plan and interventions for W1 by staff not supervising and redirecting W1 away from AV prior to W1 being able to grab AV and offering W1 a hot beverage or asking to sing a song to W1, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
