- On or about December 20, 2024, Witness 1 (W1) and Alleged Victim (AV), both residents under the care of the facility, engaged in a physical altercation causing unreasonable discomfort to AV. Based on facility documentation and interviews, W1 has known aggressive behaviors and is care planned to be monitored and redirected when he/she exhibits signs of agitation. Alleged Perpetrator 2 (AP2) is employed by facility, and responsible for providing care as outlined in resident care plans. At time of incident, Alleged Perpetrator 2 (AP2) was in a position to monitor W1's agitation and respond appropriately. While W1 began hovering over AV while AP2 was in the room, AP2 then turned and walked away just before W1 began striking AV in the face. AP2 failed to keep W1 away from other residents while W1 was agitated, which resulted in physical harm to AV due to W1 becoming aggressive and scratching AV's left wrist. AP2's actions is considered neglect of care which constitutes abuse. The facility failed to provide a safe environment for AV which is a violation of Oregon Administrative Rules.
