Findings
On or about January 8, 2025, the Alleged Victim (AV) and Witness #1 (W1) were found holding hands and kissing in the dining room. W1 is known to touch residents inappropriately and has interventions in place to prevent this action. Staff are to monitor W1 during meals and redirect if found exhibiting inappropriate behavior. On this day, no staff were watching W1, allowing this interaction to take place. Respondent failed to ensure staff followed the service plan to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
