- On or about January 30, 2025, Alleged Perpetrator 2 (AP2) was observed striking Alleged Victim (AV) with an open hand to AV's right upper arms/shoulders causing AV to respond with a sudden "jolting" movement and signs of pain and discomfort. AP2 roughly handled AV when AP2 was assisting AV with his/her Activities of Daily Living prior to evening mealtime. AV is a vulnerable person that requires complete assistance with grooming, toileting, undressing and dressing, escorting, and cuing to attend meals. Based on facility documentation and interviews, AP2 became overly frustrated with AV resulting in AP2 causing AV physical harm, unreasonable discomfort, and emotional harm. AP2's actions constitute physical abuse. The facility is responsible for the supervision, training, and overall conduct of staff when staff are acting within the scope of his or her employment duties. The facility failed to provide a safe environment for AV by allowing AP2 to physically abuse AV while AP2 was employed as caregiver, which caused AV unreasonable discomfort and emotional harm which is a violation of resident rights, is considered neglect of care and constitutes abuse.
