- On or about February 13, 2025, Witness 2 (W2) was found in the common area standing behind Alleged Victim (AV) while AV was sitting. W2 was observed to have his/her hands on AV's chest area. Based on facility documentation and interviews, W2 was known to have inappropriate sexualized behaviors, and the facility staff were directed to monitor W2, by "keeping eyes on W2". Facility staff stated that incidents involving W2 were becoming more frequent, and staff concerns were reported to facility's leadership team regarding the need for one-on-one care to prevent W2 from sexually abusing other residents. The facility failed to provide one-on-one care to prevent more incidents of sexual abuse by W2. An investigation determined that the facility failed to staff appropriately for W2's care needs and failed to put sufficient interventions in place to address W2's sexualized behaviors in order to protect others which ultimately led to an incident where W2 made inappropriate sexual contact with AV by touching that resident’s breast. The facility’s failure to put sufficient interventions in place for W2 is a violation of resident rights, is considered neglect of care and constitutes abuse
