- On or about February 13, 2025, Witness 1 (W1) was discovered in Alleged Victim's (AV) room attempting to kiss AV. Based on facility documentation and interviews, W1 and AV lack the cognitive capacity to consent to an intimate relationship. W1 has a history of engaging in sexually inappropriate behaviors towards other residents. W1 ambulates without issue and is able to quickly engage in inappropriate behaviors with other residents. An investigation determined it is impossible for staff to always keep eyes on W1 as there are routinely two caregivers in W1's living area and there are residents who require two-person assistance with tasks, which leaves W1 unsupervised. The facility failed to staff appropriately for W1's care needs and failed to put sufficient interventions in place to address W1's sexualized behaviors in order to protect others which ultimately led to an incident where W1 committed inappropriate sexual behaviors by kissing AV and grabbing AV resulting in AV experiencing unreasonable discomfort and pain. The facility’s failure to put sufficient interventions in place for W2 is a violation of resident rights, is considered neglect of care and constitutes abuse
