- The Alleged Victim (AV) relies on the facility for his/her care. Witness 1 (W1) has a history of aggression and resident-to-resident incidents. W1 is care planned for staff to re-direct W1 when he/she becomes agitated or aggressive. According to an investigation, on or about February 21, 2025, W1 became agitated while in the common area where staff were present. W1 then shoved AV and grabbed both of AV’s hands, resulting skin tears to AV’s hands. The facility failed to provide a safe environment for AV by failing to follow W1’s care plan, which is a violation of resident rights, is neglect of care and constitutes abuse.
