- Alleged Victim (AV) and Witness #1 (W1) live at Respondent’s facility. AV has a history of being involved in resident-to-resident altercations. W1 is triggered by people being in W1's personal space. The facility failed to develop sufficient person center interventions for AV's know history of resident-to-resident altercations and failed to develop person center interventions for W1's know trigger of other residents being in h/h personal space. On or about March 28, 2025, AV and W1 were in a resident-to-resident physical altercation. AV walked up to W1 and waved AV's hand in W1 face. W1 pushed AV away, causing AV to stumble, fall and hit AV's head on the floor resulting in a cut to AV's left eye. Respondent failed to develop and implement suitable interventions. This constitutes abuse by neglect as defined by OAT 411-020-0002(1)(b)(A)(I).
