- Alleged Victim (AV) and Witness 1 (W1) rely on facility staff to provide the necessary services for their health and safety. AV and W1 have history of resident-to-resident altercations. AV has history of wandering the facility and does not like it when other residents try to stop AV from doing a task that AV things need to be completed. Interventions include finding AV a task to stay busy, redirect AV to courtyard, and if AV is wandering the hallways holding an object, staff are to offer AV an activity in activity area. W1 dislikes other people wandering into W1's room or getting into W1's personal space in the dining room. interventions for W1 include, If staff see W1 leave W1's door open staff are to close it to help prevent other residents from looking in or wandering in which upsets W1. On or about April 6, 2025, AV walked into W1's room. AV and W1 started yelling at each other with W1 yelling at AV to get out of W1's room. AV did not leave W1's room and W1 got upset when AV continued to approach W1 and tried to pick up W1's shoes. AV pushed W1 and W1 pushed AV back, AV stumbled walking away and lost balance by the door and fell onto AV's stomach. The facility failed to follow W1 care plan, and failed to implement effective interventions in place, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
