Findings
The Alleged Victim (AV) resides in the Respondent’s facility and depends on facility staff for assistance with daily care needs and medication administration. AV has a metabolic disorder that requires monitoring of metabolic markers twice daily. According to AV’s service plan, AV requires staff assistance with metabolic marker injections and with medication management for injectable metabolic medication. AV moved into the facility on or about April 6, 2025. From April 7, 2025, through April 23, 2025, the facility failed to provide the required metabolic monitoring and did not consistently administer AV’s prescribed metabolic medication. As a result, AV experienced elevated metabolic markers, multiple falls with injuries, and required emergency room care. The Respondent’s failure to administer medication as prescribed constitutes abuse by neglect as defined in OAR 411-020-0002(1)(b)(A)(i).
