- On or about April 24, 2025, Alleged Victim (AV) and Witness 1 (W1) engaged in a resident-to-resident altercation while seating near each other in the activity room. It was observed that when AV tapped W1 to ask W1a question, W1 responded by punching AV in the arm. Based on facility documentation and interviews, W1 has a history of having resident-to-resident altercations due to W1 not liking other residents in his/her space. W1 is known to yell and kick if other residents get too close. At time of incident, care staff failed to appropriately monitor Witness 1 according to his/her known behavior and prior altercations. The failure resulted in a physical altercation and causing unreasonable discomfort to the AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
