- Alleged Victim (AV) and Witness 1 (W1) were placed in a shared room despite W1’s documented history of confusion, disorientation, and physical aggression, as well as a prior concern voiced by W1’s family regarding W1 having a roommate. On or about May 6, 2025, an altercation occurred between AV and W1 in the shared room, resulting in AV sustaining a skin tear and a cut above the eye. The evidence supports that the failure to adequately assess and mitigate foreseeable risk related to this room placement resulted in physical harm to AV, which is a violation of resident rights, is neglect of care and constitutes abuse.
