Findings
Alleged Victim (AV) relies on the facility for his/her care. Witness 1 (W1) has a history of inappropriately touching other residents. On or about May 17, 2025, W1 pulled AV’s pants down in the dining area. The facility reported they were going to reach out to a behavioral specialist starting on or about December 13, 2024, however, the facility did not follow through with behavioral specialist/support for W1. As a result, AV had many incidents which happened in the dining area. The facility failed to properly plan care around AV’s known behaviors, which is a violation of resident rights, is neglect of care and constitutes abuse.
