- Witness #1 (W1) has a history of being sexually inappropriate with residents and staff. It is common knowledge among staff of W1's inappropriate behaviors, however, when staff advised facility management about these behaviors, their concerns were dismissed. W1 was found in the Alleged Victim's (AV) room by staff, with his/her hands inside AV's clothing, fondling AV. Despite having multiple incidents of inappropriate behaviors, no interventions were implemented to keep AV safe from being sexually abused by W1. Respondent failed to implement interventions to reduce W1's inappropriate sexual behaviors. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
