- Alleged Victim (AV) and Witness 1 (W1) live at Respondent’s facility rely on the facility staff to ensure AV's and W1's basic care, safety and supervision requirements are met. W1 has a history of sexually touching AV and seeking AV out, including incidents that occurred in July 2025. W1's service plan reflects that W1 has history of touching and groping residents of the opposite gender, and if seen hugging or touching them, staff should redirect W1. On or about August 6, 2025, W1 was seen standing in front of AV masturbating, and on August 7, 2025, facility staff witnessed W1 in the courtyard across from AV while W1 masturbated and stared at AV. The Respondent failed to develop and implement suitable person-centered interventions which constitutes abuse by neglect.
