Alleged Victim (AV), Witness 1 (W1), and Witness 2 (W2) reside at the Respondent’s facility and rely on facility staff to meet their basic care, safety, and supervision needs. AV is known to wander the halls frequently during the day and to enter apartments when doors are open. W1 has a documented history of resident-to-resident altercations, including six incidents between July 2025 and August 2025. W2 is known to yell, which is a known trigger for agitation in W1. W1 and W2’s rooms are located across the hall from one another, and both are situated around the corner from AV’s room. On or about August 8, 2025, W1 and W2 engaged in a verbal altercation in the hallway. AV entered W1’s room. W1 returned to h/h room and blocked the doorway with h/h wheelchair, preventing AV from exiting. A physical altercation occurred, during which W1 physically removed AV from the room. AV sustained a bleeding scratch on the right cheek and red marks on the throat. Respondent failed to develop and implement appropriate interventions to address known risks. This constitutes abuse by neglect.
