- Based on witness statements, investigator observations, and documentary evidence collected during Adult Protective Services (APS) Investigation #00421347, the APS Investigator determined that the facility failed to provide adequate supervision to ensure the safety of the Alleged Victim (AV). On or about August 20, 2025, AV was able to wander unsupervised. Due to the facility’s failure to monitor both AV and Witness 1 (W1), despite documented behavioral histories and prior altercations, a physical altercation occurred in which W1 struck AV, resulting in physical pain and unreasonable discomfort to AV. Facility documentation and staff interviews confirm that appropriate supervision protocols were not followed at the time of the incident. This failure to act in accordance with AV and W1's known risk factors and behavioral patterns constitutes a violation of resident rights, is considered of neglect of care, which constitutes abuse.
