Findings
On August 25, 2025, ODHS Adult Protective Services (APS) conducted investigation #00422396 and issued a written investigation report, which is incorporated here by reference. Alleged Victim (AV) lived at Respondent’s facility. On or about August 25, 2025, the Alleged Victim (AV) was discovered in their bed with an overfilled incontinence brief saturated with urine and feces. Fecal matter was also observed on AV’s bedding, and AV emitted a strong odor of urine and feces, indicating prolonged exposure. Based on facility documentation and interviews, AV requires frequent changing as AV becomes uncomfortable and agitated when even slightly soiled. At time of incident, AV's incontinence brief was visibly observed saturated, and AV exhibited nonverbal signs of agitation prior to being changed. These signs were consistent with AV’s known care needs and documented behavioral responses to soiling. The delay in providing appropriate incontinence care resulted in AV remaining in a soiled condition for an extended period, causing unreasonable discomfort which is a violation of resident rights, is considered neglect of care, which constitutes abuse.
