- Alleged Victim (AV) and Witness 1 (W1) live at the Respondent’s facility and depend on facility staff to ensure that basic care, safety, and supervision requirements are met. AV and W1 have a known history of resident-to-resident altercations involving other residents in the facility and have established interventions in place to reduce risk to themselves and others. On or about August 26, 2025, AV and W1 were involved in a resident-to-resident altercation in the dining room. AV became agitated while seated at a dining table and began hitting the table loudly. W1, was seated at the same table with ice cream, became agitated by AV’s behavior, threw the ice cream at AV, and a physical altercation between AV and W1 ensued. The Respondent failed to follow the service plan, implement the interventions, and provide adequate supervision for AV and W1. This constitutes abuse by neglect as defined in OAR 411-020-0002(1)(A)(i).
