- Alleged Victim (AV) and Witness #1 (W1) are residents in the care of the memory care facility. AV and W1 have been roommates since August 28, 2025. AV does not have a history of altercations with other residents, W1 has had several prior altercations with other residents and roommates. It is known W1 becomes agitated when W1's family leaves the facility after a visit, W1 becomes agitated when there is too much activity around W1, like W1's roommate comes in and out of their shared room too frequently. On or about September 9, 2025, W1 was upset after W1's family said goodbye and was observed tossing things around W1's closet. AV went in and out of AV/W1's shared room multiple times after W1's family left. AV came out of the room AV and W1 share and told staff that W1 had punched AV in the face twice. AV had a small area of swelling on AV's upper lip as a result of being hit by W1. The facility failed to follow interventions put into place for W1 despite W1 appearing agitated and upset, which is a violation of resident’s rights is neglect of care and constitutes abuse.
