- The Alleged Victim (AV) and Witness #1 (W1) have been involved in previous altercations with each other and an interim service plan was in place to redirect the two when they are in the common area together. On or about September 14, 2025, AV and W1 were walking together and W1 back handed AV on the side of his/her head. There were no witnesses to this altercation, however, W1 reported to staff that he/she hit AV. The facility failed to follow the interventions in place to reduce altercations between AV and W1. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
