- The Alleged Victim (AV) relies on the facility for their care and has a history of wandering. Witness 1 (W1) shares a living space with the AV and is known to be frustrated when the AV wanders onto their side of the living space. According to an investigation, on or about, September 23, 2025, W1 pushed the AV from W1s bed, resulting in a skin tear. The AV and W1 were involved in three additional altercations, on September 27, 2026, September 28, 2026, and October 8, 2026. The facility failed to adequately respond to the on-going behaviors of the AV and W1 to ensure a safe environment which is a violation of resident’s rights, is neglect of care, and constitutes abuse.
