Findings
Alleged Victim (AV) and Witness 1 (W1) live at the Respondent’s facility and depend on facility staff to ensure that basic care, safety, and supervision requirements are met. W1 has a known history of resident-to-resident altercations involving other residents in the facility and has established interventions in place to reduce risk to others. On or about November 25, 2025, AV and W1 were involved in a resident-to-resident altercation in the dining room. AV and W1 were both sitting at a dining table, they were heard arguing, W1 scooted closer to AV and slapped AV on the right cheek, resulting in redness to AV's cheek. The Respondent failed to follow the service plan, implement the interventions for W1, and provide adequate supervision for AV and W1. This constitutes abuse by neglect as defined in OAR 411-020-0002(1)(A)(ii).
