- Alleged Victim (AV) relies on the facility for his/her care and safety. On or about December 14, 2025, AV and Witness 3 (W3) were involved in an altercation when AV attempted to take an object that was next to W3. W3 grabbed AV’s arm and pushed AV away, which caused AV to fall. On December 22, 2025, AV and W3 got into an altercation. AV was sitting next to W3 and must have been making noises that W3 did not like and W3 slapped AV across the face. AV has a history of wandering into other’s personal space, as AV does not have an awareness of other’s space. When AV wanders into other’s space, AV has been known to make clicking/whistling sounds along with talking to AV’s self in loud manner, which can be trigger to other residents including W3. W3 was known to be easily agitated by certain types of sounds/noise. Respondent failed to provide a safe environment, to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
