- The Alleged Victim (AV) and Witness 1 (W1) both relied on the facility for care. W1 had a documented history of inappropriate sexual behavior with other residents and was care planned to be escorted any time they were outside of their room. According to an investigation, despite W1's documented history, and originally ensuring staff were with W1 anytime W1 left their room, from the end of November 2025, until January 2026, W1 had "free range" to roam the facility alone. During that time, W1 was observed several different times entering AV's apartment and alone with AV in AV's apartment, placing AV at risk of harm. The facility failed to provide service, to include following the care plan and/or implementing interventions to mitigate W1 known behaviors and ensure AV's safety, which is a violation of resident rights, is considered neglect of care and constitutes abuse as defined by OAR 411-020-0002(1)(b)(A)(ii).
