- Alleged Victim’s (AV’s) behavioral plan notes, he/she will go into other resident's rooms and will take things if not caught before AV exits their room. On or about January 29, 2026, AV wandered into Witness 1’s (W1's) room. When W1 saw AV, W1 began to yell at AV to get out. AV yelled back, then W1 got angry and W1 attempted to kick AV in the shin. AV then tried to hit W1. AV had three (3) prior alterations in the month of January with other residents. Respondent failed to provide a safe environment for AV resulting in multiple alterations, and to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
