- Findings
- The Alleged Victim (AV) relies on the facility for his/her care. AV's care planned meal safety interventions, dated May 23, 2025 and reviewed August 18, 2025, were that staff would assure AV's food was cut up. A temporary service plan, dated December 18, 2025, instructed staff that AV needs a staff member with them while they are eating. According to an investigation, on or about February 9, 2026, AV was seated at a dining table with other residents and choked on a piece of meatball sandwich, resulting in AV losing consciousness, the paramedics being called and AV transported to the hospital. There were no staff with AV during the meal and the food had not been cut up. The facility failed to ensure the service plan was followed, which is a violation of resident’s rights, is neglect of care and constitutes abuse.
