- Alleged Victim (AV) and Witness 1 (W1) are residents of a locked memory care facility and rely on the Respondent’s facility to provide a safe environment and meet their care needs. On or about February 11, 2026, the facility failed to adequately monitor both W1 and AV despite their known behaviors and history of resident-to-resident altercations. As a result, W1 and AV engaged in a physical altercation in which W1 grabbed AV’s wrist and pulled a plastic bag from AV’s hands, causing unreasonable discomfort and physical harm to AV. The facility's failure to provide adequate supervision for both W1 and AV constitutes a violation of resident rights and is considered neglect of care and constitutes abuse by neglect as defined by OAR 411-020-0002(1)(b)(i).
