Findings
Alleged Victim (AV) is care planned to receive some assistance for toileting and to be kept clean, dry and odor-free. Facility's process with complaints is assess AV, fax AV's doctor, then put on alert to monitor symptoms. AV had complaints of congestion, and a few days later was diagnosed with a lower respiratory infection. AV had complaints of diarrhea. Facility did not fax or notify the doctor of AV's complaints. AV was at risk of low oxygen levels and/or pneumonia. AV was diagnosed with lower respiratory infection which needed medication to treat. Respondent failed to provide service, to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
