- Both the Alleged Victim (AV) and Witness 1 (W1) relied on the facility for care and had history of a previous physical altercation. W1 was care planned for staff to go slow and explain what they are about to do before they do it. On or about March 19, 2026, AV and W1 were sitting near each other listening to live music. AV was becoming frustrated with W1 so facility staff quickly grabbed W1 wheelchair and attempted to move W1 to another location, resulting in W1 grabbing and hitting AV on the arm. The facility failed to provide service, to include following W1's care plan and providing a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse as defined by OAR411-020-0002(1)(b)(A)(ii).
