- On or about April 12, 2026, Alleged Perpetrator 2 (AP2) attempted to escort Alleged Victim (AV) to a dining table in the facility’s dining area for mealtime. AV resisted and did not appear willing to follow AP2. AP2 was observed pulling and tugging on AV, grasping AV’s arm and wrist, while attempting to lead AV to a seat, despite AV’s continued resistance. Under OAR?411-020-0002(1)(a)(A)(i), physical abuse includes “the use of physical force that may result in bodily injury, physical pain, or impairment,” such as shoving or pulling. Because AP2 used force to restrict AV’s movement for convenience, rather than for safety or therapeutic reasons, this conduct meets the criteria for wrongful restraint under OAR?411-020-0002(1)(h)(A)(iii) and is considered physical abuse. AP2's actions caused AV unreasonable discomfort which constitutes physical abuse. The facility failed to provide a safe environment for AV which is a violation of Oregon Administrative Rules.
