Findings
The Alleged Victim (AV) has a communication impairment and speaks in word salad. AV gets upset when staff and others don't understand him/her. Alleged Perpetrator #2 (AP2) was seen mimicking AV when speaking to AV, which made AV upset and start to cry. AP2 has denied mocking AV to upset AV, however, AV has appeared to be distressed by AP2's behavior and has cried and yelled at AP2. AP2's actions are a violation of resident rights, are considered neglect of care and constitute emotional abuse as outlined in OAR 411-020-0002(1)(d)(A)(i). The facility's failure to protect AV from emotional abuse is a violation of Oregon Administrative Rules.
