Findings
The Alleged Victim (AV) resides in the Respondent’s facility and relies on facility staff for safety, supervision and assistance with daily needs. On or about May 19, 2026, Witness 2 (W2) opened the door to AV's room. W2 reported that AV was lying in bed nude from the waist down, Alleged Perpetrator 2 (AP2) pants were down, and underwear were partially down. AP2 was over top of AV and AP2 had his/her left knee up on AV's bed. AV's dry, brief laid on the floor by the foot of the bed. The Respondent failed to ensure a safe environment for the Alleged Victim. AP2's actions are a violation or resident rights, are considered neglect of care and constitute abuse as defined by 411-020-0002(1)(f). The facility’s failure is a violation of Oregon Administrative Rules.
