- Based on interview and record review, conducted during an offsite review on 03/06/25, the facility’s failure to make records available upon request was substantiated. Findings include, but not limited to:
- On 01/13/25, the Department received notice of a complaint that qualified
for an ABST review.
- On 02/13/25, Witness 1 (ODHS LCU Staff) sent an email to the facility
requesting records, which included the following:
· Copy of the posted staffing plan;
· Staff roster with position titles;
· Resident roster with room numbers; and
· Facility schedule for the direct care staff for the date of 01/11/25.
- On 03/06/25, the Department did not receive any of the requested records.
In a telephone interview on 03/13/25, Staff 1 and Staff 2 stated they started at the facility on or about 02/27/25. Staff 1 confirmed his/her email address and stated there were approximately six known ABST record request-related emails pending response. The facility failed to provide records to Department personnel upon request which is a violation of Oregon Administrative Rules.
