- On or about October 17, 2019, Alleged Perpetrator 3 (AP3) transported Alleged Victim (AV) to an appointment in the facility bus. The facility bus was missing part of a shoulder strap so AP3 instructed AV to hold the remaining strap across AV’s chest while in transport. AP3 failed to properly secure AV which put AV at risk of harm. AP3 failed to follow the transportation procedures he/she was trained to follow which is considered neglect of care and constitutes abuse. Alleged Perpetrator 2 (AP2) transported AV back to the facility on the bus but failed to properly secure AV’s wheelchair with safety straps or tie downs. When the bus made a turn, AV fell over in the wheelchair and sustained injuries. The investigation revealed that AP2 did not have formal documentation of training on the use of safety straps on the facility buses. The allegation that AP2 failed to provide basic care or services was investigated and determined no wrongdoing by AP2. The facility failed to maintain the safety equipment on the bus and failed to appropriately train AP2 on properly securing resident equipment on the facility bus. The facility’s failures are a violation of resident rights, are considered neglect of care and constitutes abuse.
