Findings: Alleged Victim (AV) was care planned for a one-person assist with gait belt to transfer. On or about August 10, 2019, Alleged Perpetrator 2 (AP2), an administrative staff member, attempted to transfer AV without the gait belt resulting in both falling on the floor. AV sustained a skin tear injury and was transported to the hospital and treated for a fractured rib. The facility was unable to provide documentation that showed AP2 was appropriately trained in resident transfers. The allegation that AP2 was responsible for providing improper transfer assistance was investigated and determined no wrongdoing by AP2. The facility failed to ensure that a qualified caregiver was present resulting in a fall with injury, which is a violation of resident rights, is considered neglect of care which constitutes abuse.
