Findings: Witness 1 (W1) had a known history of sexual behaviors towards other residents of the opposite gender. On or about August 24, 2019, W1 and Alleged Victim (AV) were seated on a couch and holding hands. AV mouthed “help” to staff and staff moved AV to a chair and left the area. W1 followed and sat next to AV. When staff returned, W1 was witnessed touching AV in the groin area. The facility failed to protect AV from inappropriate sexual contact, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
