Findings: Alleged Victim (AV) relies on facility staff for assistance. On or about October 15, 2019, AV asked Alleged Perpetrator 4 (AP4) to assist his/her to the toilet. AP4 did not assist AV to the toilet and instead transferred his/her to his/her recliner, leading to an incident of fecal incontinence. On or about October 21, 2019, AP4 was disciplined by the facility in writing for his/her refusal to assist AV to the toilet. After the disciplinary action AP4 approached AV about his/her report that AP4 was not helped to the toilet when she/he asked. Facility staff went to speak with AV and without being asked stated that AP4 had helped AV to the toilet. AV was intimidated by AP4. AP4 had a history of inappropriate, hostile, and aggressive behavior. AP4 had been disciplined in writing for hostile behavior prior to October 15, 2019. AP4's actions are considered verbal/emotional abuse. The facility failed to protect AV from AP4's behavior, which is a violation of resident rights, is neglect of care and constitutes abuse.
