Findings: On or about December 9, 2019, as staff attempted to assist Alleged Victim (AV) with his/her cares, AV became agitated and resistant. Witness 1 (W1) entered the room and struck AV’s left hand three times with W1’s cane, resulting in an injury to AV’s knuckles. Staff had previously notified the facility of W1’s increasing aggressive behaviors towards AV but had not received direction on how to address W1’s behavior. The facility’s failure to implement interventions and appropriately care plan related to W1’s behaviors and failure to provide a safe environment for AV are a violation of resident rights, are considered neglect of care and constitutes abuse.
Sanction: ALFCP20-00285 $250.00 fine assessed
