Findings: Alleged Victim (AV) and Witness 1 (W1) had a known history of resident to resident altercations. On or about February 7, 2019, AV was in the common area watching TV, and was calling out over and over. W1 entered the common area and sat behind AV. W1 stood up and struck AV with his/her cane. The facility failed to intervene appropriately given AV and W1's history of resident to resident altercations placing AV at risk for significant harm, which is a violation of resident rights, is neglect of care and constitutes abuse.
