Findings: Alleged Victim's (AV's) neck was surgically fused straight after a car accident in 1981, and AV has limited range of motion in his/her neck. On February 15, 2020, a visitor identified AV was in pain and notified the facility. Facility staff observed AV's neck appeared to be bent to the side, mobility was significantly and abnormally restricted and winced with a staff gave AV and hug and AV said "ow." On the morning of February 16, 2020, AV was given a shower and was transported to the hospital and diagnosed with an unstable cervical fracture. The facility failed to respond appropriately to AV's change of condition identified on February 15, 2016, causing unreasonable discomfort, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
