- Findings
- Alleged Victim (AV) had a history of being resistant to incontinence cares. AV’s care plan and facility documents outline the approach to use to assist with incontinence care and staff are to stop care and re-approach later if AV is resistant. On or about February 25, 2020, Alleged Perpetrator 2 (AP2) and Alleged Perpetrator 3 (AP3) were attempting to assist AV with incontinence care. AV became resistant but AP2 and AP3 continued to provide cares, resulting in AV dropping to the floor, screaming and striking AP2 in the face. AV successfully exited the bathroom and encountered another resident which led to AV turning over the other resident’s chair. AP2 and AP3 continued incontinence care despite AV’s refusals, which is considered neglect of care and constitutes abuse. Although the facility provided training documents for AP2 and AP3 that outlines resident’s right to refuse, the facility left AV in the care of staff (AP2 and AP3) that were not experienced with residents that refuse care. The facility's failure resulted in AV experiencing emotional harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
