Findings: Alleged Victim (AV) and Witness 2 (W2) rely of facility staff for everyday tasks and supervision. On or about February 28, 2020, Alleged Perpetrator 2 (AP2) found W2 with his/her genitals exposed and AV's hand touching W2's genitals. AP2 separated W2 and AV and placed AV at the opposite end of the common area and W2 returned to his/her apartment. AP2 went to the medication room to look for a supervisors number and when AP2 returned to the common area AV and W2 were found in a third party's apartment and W2 had his/her genitals exposed a second time and was standing over AV with his/her hands held down to the wheelchair. AV was tearful and more elevated. AP2 neglected AV following the first incident because he/she moved AV to the far end of the facility and returned to the medication room leaving AV unsupervised which resulted in the second incident. AP2's actions are considered neglect of care and constitutes abuse. The facility failed to protect AV from sexual abuse which is a violation of Oregon Administrative Rules.
