Findings: On or about March 22, 2020, Alleged Victim (AV) and Witness 1 (W1) had an altercation that caused AV injury when W1 bit AV's chest and placed his/her hands around AV's neck. At the time of the incident, the facility was not following W1's Behavioral Monitoring Plan for (twenty-four) 24 hour supervision. An investigation determined that between March 4, 2020 and March 19, 2020, facility staff documented six (6) incidents wherein W1 was observed to be invading other residents' personal space. The facility failed to follow W1’s care plan and failed to protect AV from W1's aggressive behaviors which is a violation of resident rights, is considered neglect of care and constitutes abuse.
