Findings: On or about April 13, 2020, Witness 1 (W1) was discovered in AV's room engaging in sexual contact that AV stated was not wanted. The facility moved W1 to a room further away from AV and put a temporary service plan in place to closely monitor the whereabouts of AV and W1 to prevent any further occurrences. On or about April 15, 2020, W1 was discovered in AV's room engaging in sexual contact that AV stated was not wanted, and this time W1 was partially disrobed. The facility failed to follow W1's temporary care plan causing AV emotional harm and putting AV at risk for serious harm, which is a violation of resident rights, is neglect of care and constitutes abuse. **On August 11, 2020 the facility closed, therefor a civil penalty will not be issued.**
