Findings: The facility failed to implement interventions and appropriately care plan regarding Witness 1's (W1) known sexual behaviors. On May 4, 2020, due to Alleged Victim (AV) exhibiting a negative reaction to sexual encounters with W1, facility staff were instructed to keep W1 away from AV. After May 4, 2020, four more sexual encounters occurred between W1 and AV. The facility failed to provide a safe environment for AV, resulting in AV having sexual encounters with W1 that resulted in serious emotional harm and put AV at serious risk of harm. The facility's failure is a violation of resident rights, is considered neglect of care, and constitutes abuse.
