Findings: The facility failed to follow Alleged Victim's (AV) care plan to be assisted by a caregiver during mealtime. As a result, Witness 1 (W1) who is also a resident at the facility believed it was his/her job to feed AV. On May 8, 2020, W1 slapped AV's hands while feeding AV at lunchtime which resulted in the facility updating AV's and W1's care plan to not be seated together for meals. However, on May 9, 2020, W1 slapped AV's hands again while at lunch when W1 took over feeding AV. The facility's failure led to the altercation between AV and W1 which is a violation of resident rights, is considered neglect of care and constitutes abuse.
