Findings: The facility failed to provide Alleged Victim (AV) with basic care and services to maintain AV's overall health and safety. AV is known to have challenging behaviors when facility staff assist him/her with Activities of Daily Living. AV often refuses assistance with care, medication, and eating. On or about May 22, 2020, AV's doctor advised facility staff to take AV to the hospital due to AV's continual resistance to care. On or about May 23, 2020, AV had not been sent to the hospital as planned due to AV's behaviors. An investigation determined that the facility failed to properly plan care for AV's behaviors for refusing care. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
