- Findings
- The facility failed to provide a safe medication administration system for the Alleged Victim (AV). On or about June 3, 2020, AV notified staff that he/she did not receive his/her medication that morning from Alleged Perpetrator #2 (AP2). During the investigation, staff found that two pills were still in the med cart for AV on June 3, 2020. Staff notified Alleged Perpetrator #3 (AP3) of the incident on June 3, 2020. AP3 reportedly did not respond until after AP2 had already been at work for a couple of hours on June 4, 2020, allowing AP2 to have access to the med cart after the incident. The pills from the prior day were missing and the MAR was filled out as the pills had been given as directed on June 3, 2020. AP2 allegedly failed to give the AV his/her pills as ordered. An investigation inconclusively determined that no AP2 wrongdoing or abuse occurred. AP3's actions were initially considered neglect of care and constituted abuse. As the result of the filing of a Petition for Reconsideration and further investigation, it has been determined that AP3's actions were not neglectful and therefore AP3 is not responsible for abuse. The facility's failure to provide a safe medication administration system is a violation of resident rights, is considered neglect of care and constitutes abuse.
